Terms of Service

Effective August 18, 2026 · Sensitive Materials LLC

1. Acceptance of Terms

By accessing or using NextToStage (nexttostage.com), operated by Sensitive Materials LLC (“Sensitive Materials,” “we,” “us,” or “our”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.

NextToStage is a business tool. It is intended for use by dance competition organizers and event staff acting on behalf of an organization, not for personal or consumer use.

2. Eligibility and Accounts

  • You must be at least 18 years old and authorized to act on behalf of the organization you represent to create an account.
  • You are responsible for maintaining the security of your account and for all activity under it.
  • Account access is invite-based, tied to a specific role (e.g., emcee, backstage, stage manager, lighting, media) — you agree to use the Service only within the scope of your assigned role.
  • You agree to provide accurate information when creating or updating your account.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation
  • Attempt to gain unauthorized access to any part of the Service, other accounts, or connected systems
  • Interfere with or disrupt the Service, including during a live event
  • Reverse engineer, decompile, or attempt to extract the source code of the Service, except where applicable law expressly permits it
  • Scrape, harvest, or otherwise systematically collect data from the Service
  • Upload or submit content you do not have the right to submit

4. User Content and Event Data

“User Content” means routine information, schedules, staff communications, and any other data entered into the Service by you or your organization. This routinely includes the names of minors (dancers) as entered by studios and competition staff.

By submitting User Content, you represent that you (or the organization you represent) have the right to submit it, and you are responsible for ensuring appropriate consent has been obtained from parents, guardians, studios, or other relevant parties for any information about minors included in that content. Sensitive Materials is not responsible for verifying the consent basis behind data submitted by its customers.

You grant Sensitive Materials a limited license to host, process, transmit, and display User Content solely as necessary to provide the Service to you.

5. Live Event Service Availability

The Service depends on internet connectivity, third-party infrastructure, and systems outside our direct control. While we work to keep the Service reliable during live events, we do not guarantee uninterrupted availability, and we are not liable for service interruptions, delays, or failures during a live show, including those caused by internet connectivity, device issues, or third-party infrastructure outages.

You are strongly encouraged to maintain a backup plan for running your event (e.g., a printed run sheet) independent of the Service, particularly for time-sensitive live-show functions.

6. Fees and Payment

Paid features of the Service are governed by a separate Subscription Agreement or Pilot Agreement between you and Sensitive Materials. In the event of a conflict between that agreement and these Terms regarding payment terms, the Subscription or Pilot Agreement controls.

7. Intellectual Property

The Service, including its design, code, and trademarks, is owned by Sensitive Materials LLC. These Terms grant you a limited, non-exclusive, non-transferable license to use the Service as intended — they do not transfer any ownership rights to you.

8. Termination

  • You may stop using the Service at any time.
  • We may suspend or terminate access for violation of these Terms, non-payment (where applicable), or at our discretion with reasonable notice where practical.
  • Upon termination, your right to access the Service ends. Data retention and deletion following termination are addressed in the Privacy Policy.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SENSITIVE MATERIALS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING FROM YOUR USE OF THE SERVICE. SENSITIVE MATERIALS LLC’S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO SENSITIVE MATERIALS LLC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

11. Indemnification

You agree to indemnify and hold harmless Sensitive Materials LLC from any claims, damages, or expenses arising from your use of the Service, your User Content, or your violation of these Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you and Sensitive Materials LLC consent to the personal jurisdiction of those courts.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by an updated “Last updated” date, and where appropriate, additional notice will be provided.
